This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'the CrPC') by the Petitioner-A.1 in Cr.No.6 of 2015 of Hanuman Junction Police Station registered for the offences punishable under Sections 324 read with 34 of I.P.C. and under Section 3(1)(x) of the Scheduled Caste and Scheduled Tribes(POA) Act(for short, 'the Act'), on the fie of the II Additional Judicial Magistrate of First Class, Nuzvid, Krishna District, praying to quash the proceedings in said crime.
2. Heard the learned counsel for the petitioner so also the learned Public Prosecutor representing State-1st respondent before ordering notice to the 2nd respondent/defacto-complainant and before admission and perused the material on record.
3. As the material falls short for this Court to admit the application under Section 482 of Cr.P.C., the Criminal Petition is disposed of from the petitioner otherwise entitles to the concession of regular bail, with a direction to surrender before the learned Special Judge and move an application for regular bail with a notice to the Special Public Prosecutor concerned and in such an event, the learned special Judge to consider the same by granting bail preferably on the same day with necessary conditions. The learned Magistrate may consider to dispense with their presence at post bail stage before the Court pending the final report by police so as to summon thereafter if any cognizance is taken. Consequently, miscellaneous applications, if any, pending in this Petition shall stand closed.
