THE HON'BLE SRI JUSTICE P.KESHAVA RAO I.A.NO.3 OF 2017 (CRL.R.C.M.P.No.4686 of 2017) IN/AND CRIMINAL REVISION CASE No.2874 of 2017 ORDER:
Challenging the judgment dated 18.04.2016 passed by III Additional Metropolitan Sessions Judge, Hyderabad in Crl.A.No.1233 of 2014 confirming the conviction and sentence imposed in C.C.No.333 of 2013 by the XIV Special Magistrate, Hyderabad dated 08.12.2014, the present revision is preferred by the accused.
The de facto complainant-first respondent in the revision filed I.A.No.3 of 2017 (Crl.R.C.M.P.No.4686 of 2017) stating she has entered into compromise with the revision petitioners-accused and therefore, prayed to grant permission to compound the offence under Section 138 of Negotiable Instruments Act and to set aside the conviction and sentence imposed against the accused. To that effect, both the parties as well as their counsel have signed on the joint memo annexed to I.A.No.3 of 2017 (Crl.R.C.M.P.No.4686 of 2017). The parties, who are present in the Court, are identified by one another and also by their respective counsel. Photocopies of identity proof of the parties are filed and they are made part of the record.
Accordingly, I.A.No.3 of 2017 (Crl.R.C.M.P.No.4686 of 2017) is ordered and the compromise is recorded. Consequent thereto, the Criminal Revision Case is allowed in terms of the joint memo filed by the parties setting aside the judgment in C.C.No.333 of 2013 by the XIV Special Magistrate, Hyderabad dated 08.12.2014
as confirmed in Crl.A.No.1233 of 2014, dated 18.04.2016 by III Additional Metropolitan Sessions Judge, Hyderabad. Pending miscellaneous petitions, if any, shall stand closed. ___________________ P.KESHAVA RAO,J 13th JUNE 2018.
