THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38432 of 2016 ORDER:
This writ petition is filed seeking to call for records in Crime No.264 of 2014 and to quash the same.
Heard and perused the material available on record. The case of the petitioner is that the 4th respondent has filed complaint before the 3rd respondent alleging that the children of the 4th respondent allegedly invested money with cold storage of the petitioner and the 4th respondent gave surety of his property and the said complaint was registered as Crime No.264 of 2014 for the offences under Sections 420, 468, 465, 417, 418, 471 read with 334 IPC. The main grievance of the petitioner is that respondents 2 and 3 are trying to arrest the petitioner without following procedure under Section 41-A of Cr.P.C.
Learned counsel for the petitioner submitted that the complaint is of the year 2014 and that the petitioner is ready to co-operate with the investigation.
Considering the grievance of the petitioner and the submissions of the learned counsel for the petitioner, the 3rd respondent is directed to complete the investigation in Crime No.264 of 2014, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner.
Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 9th November, 2016 KL
