THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.39999 OF 2015 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

The petitioners seek consideration of their application seeking 'No Objection Certificate' (NOC) under G.O.Ms.No.307, dated 06.06.2013.

The petitioners claim to be the legal heirs of an Ex-serviceman, who was assigned the land in question, and now the petitioners seek NOC to permit them to alienate the said land. The petitioners filed application seeking NOC before the District Collector, West Godavari District, Eluru, the 2nd respondent, only on 18.11.2015 and have moved the present Writ Petition on 08.12.2015. Hence, I do not see any inaction on the part of the respondents warranting entertainment of this Writ Petition and the matters of this nature are coming up before this Court repeatedly. The petitioners'

application for NOC may deserve appropriate consideration from the 2nd respondent, but I do not see any inaction so as to give an appropriate direction to the 2nd respondent. Hence, the Writ Petition is disposed of directing the 2nd respondent to consider the application of the petitioners as expeditiously as possible and pass appropriate orders in accordance with law. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
