THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.36020 of 2017 ORDER:

Heard Mr T.P.Acharya, counsel for petitioner and Assistant Government Pleader for Home.

The petitioner prays for the following relief: ".............writ of mandamus directing the respondents particularly respondent No.4 not to call the petitioner to police station and harass him and force him to give share to petitioner's daughter......"

The 3rd respondent places on record the written instructions dated 27.10.2017.

The operative portion reads thus:

"Basing on the complaint given by the daughter of the petitioner dated 18.06.2017, a petty case was registered vide STC.No.1316/2017 and the same was convicted on 29.06.2017 by imposing Rs.500/- before the 2nd Special Judicial II Class Magistrate at Khammam. Except that the respondent police never called the petitioner to the police station, never harassed and forced the petitioner to give share to petitioner's daughter as alleged by him, hence the allegations against the police are false and baseless and denied."

From the above, it is clear that the respondents deny allegation of interference either with liberty or civil dispute between petitioner and his daughter.

The submission of SHO, Khammam Rural Police Station is placed on record and accepted.

The writ petition is accordingly disposed of and the 3rd and 4th respondents shall not interfere in civil dispute or unnecessarily call the petitioner to Station. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
