THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.22646 of 2016 ORDER:

Suspension pending enquiry order dated 30.06.2016 passed by the 3rd respondent-The District Supply Officer vide proceedings No.C2/2594/2016 is challenged before this Court. As can be seen from the averments of the affidavit filed in support of the writ petition, petitioner is the Fair Price Shop dealer in respect of shop No.838 at D.No.8-3-189, Chapal Bai, Bandimet, Monda Market, Secunderabad, and he has been running the same since 23 years. While so, on 23.06.2016 the 4th respondent- Senior Checking Inspector inspected the shop of the petitioner and found certain variations in stocks i.e.(1) qtls. 3.52 kgs rice excess (2) Qtls.1.10 kgs wheat shortage (3) 2 half kg. packets sugar excess and (4) 35 ltrs. of kerosene oil shortage. Accordingly the 4th respondent submitted a report to the 3rd respondent. Basing on said report, the 3rd respondent issued the impugned order suspending authorization of the petitioner pending enquiry. Hence, this writ petition.

According to the report submitted by the 4th respondent, the variations are beyond permissible limits. Hence, this Court is not inclined to interfere with the impugned order. However, as the suspension is being effected on 30.06.2016 and the suspension cannot be for an indefinite period, the 3rd respondent is directed to complete the enquiry after issuance of notice and calling for explanation from the petitioner. The entire exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order. If enquiry is not completed and no orders are passed within eight weeks, the authorization of the petitioner stands

restored.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending in this writ petition, if any, shall stand closed.
