The petitioner prays for the following relief: ...this Hon'ble Court may be pleased to issue a writ or order more particularly one in the nature of writ of mandamus declaring the action of the respondents 2 to 8 in interfering with day to day business of the petitioners without there being any cause and grievance against the petitioners that too without following due process of law as illegal, arbitrary, unjust and also against the Article 21 of Constitution of India and consequential directions to the respondents not to interfere with day to day business of the petitioners and to pass....
The Assistant Government Pleader, on instructions, submits that respondents are not interfering with the petitioners' possession or enjoyment of subject matter of writ petition. This Court is of the view that the respondents since have registered a crime are expected to follow the procedure and the interference alleged in the writ petition is not made out. If at all the presence of petitioners is required in a crime registered or otherwise, the same shall be in accordance with law.
The writ petition is, accordingly, dismissed by placing on record the statement of Assistant Government Pleader. There shall be no order as to costs.
