THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.37350 of 2017 ORDER:

The petitioners pray for the following relief: "...........to issue a writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 1st respondent for harassing the petitioners by calling to the police station relating to crime vide FIR No.707 of 2017 on the file of the 1st respondent is illegal, arbitrary and un-constitutional and consequently direct the 1st respondent herein not to harass and not to interfere without following due process of law......." According to petitioners, though the petitioners are in no way connected with the crime, pending investigation, are subjected to Police Station and are harassed by 1st respondent.

Mr. Rajendra Bussa has substantially reiterated the grounds raised in the writ affidavit.

The Assistant Government Pleader from the record submits that FIR 707 of 2017 is registered against N.Krishna Murthy (husband of 1st petitioner etc.). The complaint refers to receipt of chit instalments etc., by petitioners and this Court, if interdicts in the pending investigation in FIR No.707 of 2017, the same amounts to stifling to the discretion available to the Investigating

Officer in this behalf. He further submits that either in the course of investigation or after investigation progresses, the Investigating Officer is of the view that the presence of the petitioners is also required in the pending FIR, their presence is ensured, in accordance with law.

The statement is placed on record and the writ petition is disposed of, accordingly. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
