HON'BLE SRI JUSTICE S.V. BHATT W.P.No.36013 OF 2017 ORDER:

The petitioner prays for the following relief: "......this Hon'ble Court may be pleased to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus by declaring the action of the respondents No.1 to 5 herein in not providing police aid in implementation of the temporary injunction order granted in my favour in IA.No.201/2016, dated 28-02-2017 in OS.No.91/2016 pending before the Trial Court restraining the respondents No. 7 & 8 herein from interfering with peaceful possession and enjoyment in respect of the subject land covered in the above suit, as arbitrary and illegal and by setting aside the order passed in IA.No.249/2017, 04-09-2017 in O.S.No.91/2016 on the file of the Learned Junior Civil Judge at Sulthanabad in Peddapalli District and further be pleased to direct the respondents No.

1 to 5 herein to provide police protection for implementation of the injunction order in favour of the petitioner in the interest of justice Now, the complaint of petitioner is that respondents 6 to 8 are interfering in civil disputes. The petitioner has already filed O.S.No.91 of 2016 in the Court of Junior Civil Judge, Sulthanabad, Peddapalli District for perpetual injunction restraining respondents 6 to 8 from interfering with her property. The petitioner filed I.A.No.249 of 2017 seeking police protection, but the same was dismissed by the trial Court on 04.09.2017. The petitioner has also filed I.A.No.248 of 2017 for detaining respondents 7 and 8 in civil prison for disobeying the order of temporary injunction granted by the trial Court in I.A.No.201 of 2016, which is pending.

Peddapalli District. This Court is not persuaded to entertain the writ petition. The petitioner is required to work out the remedies in O.S.No91 of 2016, which is pending before the trial Court. The writ petition fails and is, ac cordingly, dismissed. There shall be no order as to costs.
