HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.11357 of 2018 ORDER:

The Petitioner is A1 in F.I.R. No.634 of 2017 dated 20.11.2017 of Machavaram Police Station, Vijayawada City, Krishna District, registered for the offences punishable under Sections 468, 471 r/w 34 IPC.

Heard the learned counsel for petitioner, and the learned Additional Public Prosecutor representing the respondent No.2-State. 3.

There is nothing to quash the proceedings in F.I.R. No.634 of 2017 dated 20.11.2017 of Machavaram Police Station, Vijayawada City, Krishna District, but for to say for none of the offences are punishable above seven years, the police not to arrest the petitioner and secure the presence of petitioner during investigation. If the petitioner failed to attend, the police strictly follow Section 41-A Cr.P.C. and also the guidelines as held by the Apex Court in Arnesh Kumar v. State of Bihar1.
