THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7928 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus - a) declaring action of the respondents in not considering the case of the petitioner for compassionate appointment to any suitable post under compassionate appointment scheme as illegal, arbitrary, violative of principles of natural justice, contrary to Articles 14 and 16 of the Constitution of India and violative of Presidential Order 1975; and b) Consequently direct the respondents to consider the case of the petitioner for appointment for any suitable post under compassionate appointment scheme with all consequential benefits."

Heard Sri N. Ramesh, learned counsel for the petitioner and Sri A. Rama Rao, learned Standing Counsel for respondents. When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 0308-2011 to the 3rd respondent herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 3rd respondent to pass appropriate orders on the representation, dated 03-08-2011, in accordance with law, by fixing some timeframe. The said request is not opposed by the learned Standing Counsel for respondents.

For the aforesaid reasons, the writ petition is disposed of,

without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 3rd respondent to consider and pass appropriate orders on the representation, dated 03-08-2011 said to have been submitted by the petitioner herein, in accordance with law, within a period of six

(6) weeks from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
