HON'BLE SRI JUSTICE DILIP B. BHOSALE CIVIL REVISION PETITION Nos.3884 and 4839 of 2014 COMMON ORDER :

Learned counsel appearing for the petitioners in these civil revision petitions do not press the civil revision petitions on merits and seeks direction to the Family Court to decide O.P.No.216 of 2013 within time frame.

2. O.P.No.216 of 2013 is filed by the father under the provisions of Guardians and Wards Act, 1890, seeking custody of their son - Syed Azber Hussain. The father-husband is a resident of U.S.A. and often visits India to meet his child. Keeping that in view, and considering the submissions of learned counsel for the petitioners, I am satisfied that the following order shall meet the ends of justice:

The civil revision petitions are disposed of as not pressed. The Family Court shall endeavour to dispose of O.P.No.216 of 2013 as expeditiously as possible and preferably within a period of six months from the date of receipt of this order. It is needless to mention that the husband shall make himself available for concluding the trial within the stipulated time and shall avoid to seek any adjournments. Consequently, miscellaneous petitions pending, if any, also stand disposed of. No order as to costs.
