THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.38184 of 2017 ORDER:

The petitioner was appointed as an Armed Reserve Police Constable by proceedings dated 10.08.1990. His services were terminated during the period of probation vide proceedings dated 29.07.1995 and the same was confirmed by the higher authorities. Challenging the same, the petitioner filed O.A.No.2890 of 2006 before the Andhra Pradesh Administrative Tribunal and the same was disposed of on 02.02.2007 upholding the order of termination during the probation. But, the respondents were directed to consider the case of the petitioner for engaging in any other post other than the post of Constable. When the petitioner submitted a representation, the third respondent issued a memo on 23.05.2007 rejecting his claim for alternative employment. Challenging the same, the present Writ Petition is filed.

Since the present Writ Petition is filed after a period of ten years from the date of the impugned order dated 23.05.2007, this Court is not inclined to exercise its discretion for entertaining the present Writ Petition. This is more so when the termination of the petitioner was upheld by all the authorities, including the Andhra Pradesh Administrative Tribunal.

The Writ Petition is, therefore, dismissed at the admission stage. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 14.11.2017 vs
