THE HON'BLE SRI JUSTICE S.V.BHATT CONTEMPT CASE No.665 of 2016 ORDER:

Heard Smt. D. Lalitha Prasad for petitioner and Mr. Ravi Cheemalapati for respondent.

2. On 02.06.2016, at request of respondent, the matter is adjourned to today for filing counter affidavit and also documentary evidence to show that the respondent, in fact, did not demolish or disobey the order of this Court dated 26.02.2016.

3. The respondent filed counter affidavit and at more than one place, he has stated that the respondent did not demolish any of the structures covered by Door No.14-96 in R.S.Nos.750/1 and 783/1 at Kamavarapukota Village and Mandal, West Godavari.

4. I have perused the counter affidavit filed by the respondent together with the photographs taken on 04.06.2016. Prima facie, I am satisfied that though attempt was made to remove the encroachments, the respondent did not do anything beyond marking physical presence at site. The contempt case is closed. The parties are given liberty to work out their grievance in the pending writ petition. This Court is not expressing any view as to whether there is any encroachment by petitioner in R.S.Nos.750/1 and 783/1 or not. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
