HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.11402 of 2018 ORDER:

The petitioners are accused Nos.1 & 2 of S.C.No.140 of 2018 pending on the file of learned I Additional Metropolitan Sessions Judge, Nampally, Hyderabad, for the offence punishable under Section 307 r/w 34 IPC, outcome of crime No.172 of 2017 dated 19.08.2017 of Reinbazar Police Station, Hyderabad. The 2nd respondent is the defacto complainant and the 3rd respondent is the victim and they are the prosecution witnesses.

They stated in the course of hearing the quash petition from the applications filed in I.A.Nos.2 & 3 of 2018 to accord permission for compounding the offences. Learned Public Prosecutor opposed the same on behalf of the 1st respondentState saying both the accused are rowdy sheeters as per the police record and it is a crime against the society; it cannot be compounded from the antecedents of the petitioners/accused. At this stage to avert unnecessary controversy, the learned counsel for the petitioners seeking a direction to the learned trial Judge for speedy disposal.

Having regard to the above, this Criminal Petition itself is disposed of by directing the learned I Additional Metropolitan Sessions Judge, Nampally, Hyderabad, if charges not framed hear before charges and if not discharged take up trial and
