THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.37260 of 2017 ORDER:

The petitioner was directly recruited as Sub-Inspector of Police (Civil) in the year 1989. She belongs to Hyderabad City Police. Her probation was declared w.e.f. 15.01.1991 by proceedings, dated 21.01.1992. Later on, she was promoted as Inspector of Police and Deputy Superintendent of Police (Civil) respectively. Now she states that she secured 1830.4 marks in the examination conducted at the Police Training College, the seniority should be reckoned on the basis of marks obtained in the examination conducted during training at PTC for preparation of panels to the post of Inspector of Police (Civil). She relies on Rule 15 (a) of the Andhra Pradesh Police Subordinate Service Rules. She further states that declaration of probation has nothing to do with the previous seniority concerned in view of the said Rule.

Since she passed the Telugu Language test during the year 1999, the 1st respondent appears to have cancelled the order of probation declared on 21.01.1992 by G.O.Ms.No.224, Home (Police-C) Department, dated 28.01.1998, and the probation was extended till passing of Telugu Language test. Her probation was, thus, again declared by proceedings, dated 10.07.1999. Now the present Writ Petition is filed challenging cancellation of declaration of earlier probation on 21.01.1992 by subsequent G.O.Ms.No.224, dated 28.01.1998, and for consequential promotions. 2.

Though the petitioner stated with regard to the subsequent events that have taken place, they are not being considered in the

present Writ Petition, as the challenge is confined to G.O.Ms.No.224, dated 28.01.1998. In the affidavit filed in support of the Writ Petition, the petitioner nowhere explained the delay for coming to this Court after 20 years of passing the State Government order. During last 20 years, several promotions might have taken place consequent to cancellation of probation of the petitioner and declaration of probation at later date. In the absence of any sufficient reasonable explanation, this Court is not inclined to entertain the Writ Petition and accordingly, the Writ Petition is dismissed on the ground of laches, at the stage of admission.
