HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO PUBLIC INTEREST LITIGATION No. 257 OF 2015 PC: (Per the Hon'ble Sri Justice P.Naveen Rao) This petition is filed seeking the following relief:
"Issue writ, order or direction more particularly one in the nature of Writ of Mandamus declaring action of the respondents by not taking appropriate measures with regard to protecting the lives due to Heat Wave is illegal, and in violation of fundamental rights which are guaranteed under Constitution of India, direct the Respondents 1 to 4 to prepare action plan to mitigate Heat Wave, direct the Respondents 1, 2 to grant compensation to the families who lost their lives due to Heat Wave, direct the Respondent 1, 2 to change working hours during Heat Wave in respective states, direct the Respondent 1, to 3 to make alternative arrangements for Common Entrance Tests, Exams if there is Possibility of Heat Wave, direct the Respondent 1,2 to provide shelters, drinking water, ORS in public places, Public transport like buses, direct the Respondent 1,2 to provide free emergency health services for Heat Wave affected people on the lines of Flood effected people, direct the Respondent 1,2 to involve private companies under Corporate Social Responsibility in Heat Wave protection measures, direct the Respondent 1,2,3 to conduct publicity/awareness campaign about the effects of Heat Wave through Radio, TVs and News papers, direct the Respondents 1,2 to provide employment to employees who died due to Heat Wave, ..............
Having regard to unusual rise in temperatures and advancement of heat wave conditions in the month of March, this Court directed the respondent State Governments to prepare comprehensive Heat Wave Action Plan. Both State Governments have constituted committees to prepare comprehensive Heat Wave Action Plans and as per the recommendations of the respective Committees, both Governments have drawn up Heat Wave Action Plan, 2016. The Heat Wave Action Plan, 2016 drawn up by both the State Governments are placed on record.
3 Sri P Venugopal, learned Advocate General (AP) circulated the report submitted by the Principal Secretary to the Government, Land and Disaster Management on the further steps taken along with enclosures. The enclosures contain various measures taken by the Government of A P to create awareness among the people in taking precautions while venturing out in the sun and also various measures taken to deal with the situation. The report also explains how reviews are conducted at the highest level in the Government to emphasis that Government is conscious of the alarming situation and taking all measures to minimise the damage. The deponent assures that there would be continuous monitoring at the highest level in the Government and by the District Collectors in implementation of the action plan. The report is accepted and placed on record.
4 Sri A.Sanjeev Kumar, learned Special Government Pleader appearing for State of Telangana also assures that there will be continuous monitoring at all levels for effective implementation of the Heat Wave Action Plan. The submission is accepted and recorded.
5 Sri P.Venugopal, learned Advocate General for AP and Sri A.Sanjeev Kumar, Special Government Pleader for State of Telangana assures that as per the action plan and policies envisaged by both state Governments, victims of heat wave will be adequately compensated. The said submissions are accepted and taken on record.
We are satisfied with the measures taken by both the State Governments and it is not necessary to keep the writ petition pending any more. The Public Interest Litigation is accordingly disposed with the following directions:
a) The Governments of State of Telangana and State of Andhra Pradesh are directed to continuously monitor and take all measures to ensure that people are not affected by unprecedented heat wave conditions prevailing in both states. b) Through, electronic and print media, and by all other modes including social media they shall continuously create awareness among people to take appropriate safety measures to overcome the heat wave conditions.
c) Both state Governments shall ensure that appropriate drinking water facilities are provided, ORS facilities are made available and make available emergency medical attention whenever the competent authority receives complaint of any person/persons affected by heat wave conditions and shall make all arrangements to ensure that no loss of life is caused on account of heat wave conditions.
