HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.16032 of 2016 O R D E R :
In this writ petition, the petitioners are seeking Mandamus to declare the action of the respondents in intending to dispossess them from the House bearing No.4-200(1) together with the land situated in 2nd lane, Chandraiah Nagar, Ongole, Prakasam District, without following due process of law, and consequently sought a direction to the respondents not to disturb the petitioners from the said house and the open land without following due process of law.
The petitioners have also filed the Property Tax demand notice to show their right over the subject property. Learned counsel for the petitioners would submit that the petitioners shall not be dispossessed from the subject property unless due process of law is resorted to by the respondents. The learned Assistant Government Pleader for Revenue would concede to the said submission made by the learned counsel for petitioners.
In that view of the matter, this writ petition is disposed of directing that the petitioners shall not be dispossessed from the subject property unless due process of law is resorted to by the respondents. No order as to costs.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
