THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.34724 of 2017 ORDER:

The petitioner prays for the following relief :- " ..... to issue appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondent No.2 couldn't register FIR as per complaint submitted by the petitioner on 02-08-2017 against the respondent Nos.3 & 4 as illegal, arbitrary against Art.19 & 21 of the Constitution of India....." The Assistant Government Pleader, on instructions, submits that the complaint referred in the writ petition is not available with the 2nd respondent and if at all receives the complaint, the 2nd respondent will look into the complaint in accordance with law.

Having regard to the above submission, I am satisfied the writ petition can be disposed of by this order. (a) The petitioner is given liberty to re-submit complaint dated 02.08.2017 to 2nd respondent by enc losing a copy of this order within two weeks from today.

(b) The 2nd respondent on receipt of complaint, as stated above, proceeds in the matter in accordance with law.

The writ petition is disposed of accordingly. No order as to costs.
