THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION NO.35680 OF 2017 ORDER:

This Writ Petition is filed to declare the inaction of the first and second respondents in registering the crime and investigating the same pursuant to the complaint dated 30.01.2017 made by the petitioner, as illegal.

Learned counsel for the petitioner and the learned Government Pleader for the respondents would agree for disposal of the Writ Petition at the admission stage.

Learned Government Pleader for Home, based on the written instructions of the Sub-Inspector of Police, Medipalli Police Station, dated 30.10.2017, stated that a case in Crime No.832 of 2017 for the offences punishable under Sections 420, 406, 448, 427, 506 read with Section 34 of the Indian Penal Code was registered on the file of the Medipalli Police Station and investigation is also taken up. One Mr. Darga Sudhakar Reddy-A1 was arrested on 30.10.2017 in connection with Crime No.831 of 2017 and he was remanded to judicial custody on the same day. As accused No.1 was already arrested, a requisition was filed before the III Metropolitan Magistrate, Cyberabad at L.B.Nagar for regularization of A-1 in the present Crime No.832 of 2017. Remaining accused are absconding. The complaint of the petitioner has not been traced and hence, based on the fresh complaint, police filed Crime No.832 of 2017.

As the crime has already been registered and investigation is under process, the respondents are directed to complete the investigation as expeditiously as possible.

Accordingly, the Writ Petition is allowed. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
