HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.674 of 2015 ORDER:
This petition is filed to withdraw O.P.No.228 of 2015 from the file of Senior Civil Judge, Kakinada, and transfer the same to any Court having jurisdiction at Hyderabad.
2. Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 13.08.2014 at Railway Kalayanamandapam, Kakinada, as per Hindu rites and custom and after marriage she joined respondent and lead happy marital life for some time and thereafter respondent started harassing her. She stated that due to harassment she was forced to go back to her parents house at Hyderabad and that respondent intentionally filed O.P.No.228 of 2015 before Senior Civil Judge, Kakinada, for divorce knowing fully well that she is a housewife and do not have any source of income. She stated that distance between Hyderabad and Kakinada is more than 500 kms. and it is very difficult for her to travel from Hyderabad to Kakinada. She stated that she is not in a position to bear the travelling expenses. For these reasons, she prayed for transfer of O.P.No.228 of 2015 from Kakinada to Hyderabad.
3. This Court permitted petitioner to take personal notice to respondent through registered post with acknowledgment due and in compliance of the said order,
advocate for petitioner filed memo stating that personal notice sent to respondent through registered post is duly served and postal acknowledgment is filed along with memo. In spite of service of notice neither respondent appeared in person nor through any advocate.
4. Heard advocate for petitioner.
5. Considering the reasons stated in the affidavit and also considering the convenience of wife, O.P.No.228 of 2015 is withdrawn from Senior Civil Judge, Kakinada, and transferred to Family Court, Hyderabad, for disposal in accordance with law.
6. Accordingly, transfer C.M.P. is ordered.
7. Miscellaneous petitions pending, if any, shall stand closed.
