HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.39423 of 2017 ORDER:

The petitioner aggrieved by the withdrawal of Police protection granted to him pursuant to the order of this Court in WPMP.No.26170 of 2008 in W.P.No.20047 of 2008 more particularly when the representation is pending has filed the instant Writ Petition.

Learned counsel Sri M.Rama Rao appearing for petitioner though has made a few submissions on the right of the petitioner under Article-21 of the Constitution of India for protection as long as threat perception is continuing, at the end he submitted that the petitioner is satisfied at least if the representation dated 27.02.2017 is considered and disposed of. It is needless to observe that this Court while disposing of Writ Petition No.20047 of 2008 has made the following observations:

"After posting the matter on 12.11.2013 and 21.01.2014 the learned Assistant Government Pleader was directed to get instructions with regard to the present state of affairs and on written instructions he states that protection to the petitioner is being given by deputing Police Constable-2462

and the same protection is being continued to the petitioner as on today. On the complaint of the petitioner, 4 cases are pending trial before the Judicial Magistrate of the First Class, Sircilla. In view of the threat perception perceived by the SubDivisional Police Officer, Sircilla, Karimnagar and in view of the pendency of criminal cases on the complaint made by the petitioner, the protection to the petitioner may be continued and the same can be reviewed periodically as per law."

The representation now made may be considered and disposed of in the light of the above observations. The said exercise is directed to be taken up and completed as expeditiously as possible preferably within four weeks from the date of receipt of a copy of this order.

The Writ Petition is disposed of accordingly. As a sequel, Miscellaneous Petitions, if any, pending, shall stand closed.
