HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.35550 OF 2017 O R D E R :
The case of the petitioner is that her husband while working as police constable (No.1137) retired on 30.11.2000 under Voluntary Retirement Scheme; that the petitioner's husband earlier got married one Nasreen Jaha Begum who died on 25.04.2000; that after her death he married the petitioner on 01.07.2013, as per Muslim Law. While so, petitioner's husband died on 30.03.2016 and petitioner was also paid terminal benefits of Rs.22,270/-. The grievance of the petitioner is that the respondents refused to grant Family Pension to the petitioner. Aggrieved by the same present writ petition is filed. Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Services submits that the petitioner without making any application before the respondents, straightaway approached this Court. Learned Counsel for the petitioner submits that the petitioner will make necessary application before the competent authority.
Since the learned counsel for the petitioner states that the petitioner will make appropriate application before the competent authority, it is for the competent authority to decide whether the petitioner is entitled for family pension or not.
Having regard to the aforesaid facts and circumstances, it is open for the petitioner to make necessary application before the 4th respondent within a period of four weeks from today. On such application, the 4th respondent is directed to consider the same, in accordance with Rules and Regulations and pass orders. With the above direction, the writ petition is disposed of. No order as to costs.
