THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.36067 of 2017 ORDER:

Heard Mr Prabhakar Sripada, counsel for petitioner and Assistant Government Pleader for Home.

The petitioner prays for the following relief: ".............Writ, Order or Direction, more particularly one in the nature of writ of mandamus declaring the inaction of the Respondent No.4 in not investigating the Crime No.549 of 2017 dated 12.10.2017 in a rational manner, as illegal and unconstitutional............" The further complaint of petitioner is that at every stage, the petitioner is compelled to knock the door of this Court to fraught the respondent to discharge the function or duty under Code of Criminal Procedure in Crime No.549 of 2017. Though this Court is not, for the present, expressing any view on the lamentation of petitioner, but a passing remark is required, for the respondents are moving in the matter either leisurely or by choice.

Be that as it may. The respondents after receiving notice in the instant writ petition, placed before this Court written instructions dated 02.11.2017. The written instructions show progress of investigation in Crime No.549 of 2017 and after completing few more steps which are

envisaged as part of investigation necessary culmination has to be done in the matter.

The written instructions are placed on record and the 3rd and 4th respondents are directed to complete investigation in accordance with law.

Writ petition is disposed of, accordingly. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
