HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 38870 of 2018 ORDER:
1) Heard learned counsel for the petitioner and Sri S.D.Goud, Learned Standing Counsel appearing for the second respondent. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the second respondent in laying the road in the land of the petitioner admeasuring ac.0.4 cents in Plot Nos.1 and 2 situated in Sy.No.95/ 1 at 6th Road, Ananthapuram Municipal Corporation, as illegal, arbitrary and violative of principles of natural justice. 3) Though various grounds are raised, the only contention of the petitioner is that the authorities shall follow due process of law or pay any compensation to the petitioner for laying road in the land of the petitioner.
4) A counter came to be filed by the second respondent stating that if the petitioner has produced required documents showing that he is owner and possessor of the land, the authorities concerned shall take steps in accordance with law. 5) Having regard to the above, the writ petition is disposed of directing the petitioner to submit the documents evidencing his right, title and interest over the property, in which event the second respondent may pay suitable compensation as early as possible, preferably within a period of three months from the date
of submission of documents, if the petitioner is otherwise entitled to and found that the road has been laid through the land of the petitioner.
6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
