HON'BLE SRI JUSTICE S.V. BHATT W.P.No. 34681 of 2017 O R D E R:- Heard Sri P. Giri Krishna, counsel for the petitioner and the Assistant Government Pleader for Home for the respondents.
The petitioner prays for the following substantive relief:- " ...to issue a Writ of Mandamus or any other appropriate writ or writs, order or direction declaring the action of the 2nd respondent in harassing the petitioner on the pretext of recovery of stolen property by frequently calling him to the police station without there being any crime registered against the petitioner, as illegal, arbitrary, against the principles of natural justice and violative of Articles 19 and 21 of the Constitution of India and consequently direct the 2nd respondent not to call the petitioner to the Police Station."
The 2nd respondent filed counter affidavit denying each one of the allegations made against the 2nd respondent. The learned counsel for the petitioner submits that in view of the stand taken in the counter affidavit, the same may be placed on record and the writ petition disposed of. The stand of the 2nd respondent in the counter affidavit is noted and the writ petition is disposed of accordingly. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
