THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.34830 of 2017 ORDER:

The petitioners pray for the following relief: "...writ of mandamus declaring the action of the respondents in interfering with petitioners possession and enjoyment of the property in Sy.No.17/1A and 17/2A situated at Borancha Village, Mannoor Mandal, Sangareddy District and interfering with civil disputes as unsustainable, untenable, motivated, arbitrary, highly objectionable, unconstitutional against law as well as principles of natural justice and consequently direct the respondents not to interfere with the possession and enjoyment of petitioners property in Survey No.17/1A and 17/2A at Borancha Village, Mannoor Mandal, Sangareddy District and not to harass and detail in Police Station without following due process of law."

On 27.10.2017, the request of Assistant Government Pleader to get instructions was accepted and Assistant Government Pleader basing on written instructions dated 25.10.2017 submits that Crime No.43 of 2017 was registered on 28.09.2017. The 1st petitioner is shown as accused No.1 in the said FIR. Likewise, a complaint on non-cognizable offence is made, the 5th respondent has requested the learned Judicial First Class Magistrate to accord permission to register FIR under Section 504 of I.P.C. The permission is awaited. It is further stated that except investigating into

Crime referred to above, the 5th respondent is not interfering in the civil dispute between the petitioners and the respondents 6 to 8.

The statement is placed on record and the Writ Petition is disposed accordingly. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
