Heard Mr.S.V.V.S.V.Prasad for petitioner.
The petitioner prays for the following relief: "...this Hon'ble Court may be pleased to issue a Writ, or Order, or Direction more particularly one in the nature of writ of Mandamus declaring the action of the Respondent No.5 and 6 in interference of the Civil Disputes at the instigation of the Respondents No.7 and 8, is illegal, discriminatory and unconstitutional and against the Criminal Procedure Code and against Fundamental Rights guaranteed Under Article 14, 19 and 21, by the Constitution of India and against the directions given by this Hon'ble Court by way of various Judgments and consequently direct the police to give protection to the petitioner, and her properties, and pass....." Now, the complaint of petitioner is that respondents 5 and 6 at the instance of respondents 7 and 8 are interfering in civil disputes.
The petitioner has already filed O.S.No.262 of 2017 in the Court of XVI-Additional Junior Civil Judge, Miyapur for perpetual injunction restraining respondents 7 and 8 from interfering with the property. The writ prayer, this Court is constrained to observe, is in addition to the remedies already being worked out before the XVI-Additional Junior Civil Judge, Miyapur. Prima facie, this Court is of the view that the writ petition is misconceived. The petitioner is required to work out the remedies in O.S.No.262 of 2017.
The writ petition fails and is, accordingly, dismissed. There shall be no order as to costs.
