THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.11218 of 2016 ORDER:

This criminal petition is filed to quash the proceedings in C.C.No.200 of 2011 on the file of the III Additional Metropolitan Magistrate, Vijayawada.

Heard both sides.

Having regard to the facts and circumstances of the case, I am not inclined to quash the impugned proceedings. However, it is open for the petitioner/accused to surrender before the Court below and file appropriate application within two weeks from today to recall the warrant. In such an event, the Court below shall dispose of the application of the petitioner on the same day on which it is filed on condition of the petitioner executing a bond for Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the III Additional Chief Metropolitan Magistrate, Vijayawada.

The Criminal Petition is accordingly disposed of. Pending miscellaneous applications, if any, shall stand closed in consequence.
