This Contempt Case is filed alleging wilful disobedience of Order, dated 05-12-2013, in WP.No.31239 of 2012, by the respondents.
The respondents have filed separate counteraffidavits wherein they have categorically agreed to handover the land in Bandaraviryala Village, as agreed by them earlier, based on which, this Court has disposed of WP.No.31239 of 2012.
Mr.Vedula Srinivas, learned Counsel for the petitioner, submitted that the land, which was agreed
to be handed over, does not contain any rock for mining purpose. I am afraid this plea cannot be entertained in a Contempt Case as, on the petitioner's acceptance of the offer of the respondents, this Court has disposed of the Writ Petition. If the land is not suitable for mining purpose, the respondents cannot be held guilty of the contempt.
In this view of the matter, the Contempt Case is closed and the respondents are discharged from the contempt proceedings with liberty to the petitioner to avail appropriate remedies available to him in law. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 4th September, 2015 LUR
