HON'BLE SRI JUSTICE Dr. B. SIVA SANKARA RAO Criminal Petition No.11404 of 2018 ORDER:

The petitioner is A1 in Crime No.43 of 2018 of Women Police Station, CCS, Hyderabad, registered for the offences punishable under Sections 498A & 406 IPC and Sections 3 & 4 of the Dowry Prohibition Act.

Heard the learned counsel for petitioner before ordering notice before admission to respondent No.2-de facto complainant, and also the learned Additional Public Prosecutor representing the respondent No.1-State in opposing the same and perused the F.I.R. and the quash petition averments.

A perusal of the material on record no way entitles to entertain this Criminal Petition much less to admit and keep it pending by ordering notice to respondent No.2 for no grounds to quash, but for to say for none of the offences are punishable above seven years, the police strictly follow Section 41-A Cr.P.C. and the guidelines of the Apex Court in Arnesh Kumar Vs. State of Bihar1. Accordingly, this Criminal Petition is disposed of.
