HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.38346 of 2017 ORDER:

Heard Sri K.Syam Sundar for petitioner and the Assistant Government Pleader for Home.

The petitioner prays for the following relief :- " ...... to issue a Writ, Order, Order or Direction more particularly one in the nature of WRIT OF MANDAMUS, declaring the action of the Respondents Police have no role in civil litigation and no jurisdiction to interfere in civil disputes and further interfering with the petitioner's possession and enjoyment of the land admeasuring Ac. 0.16 cents, in R.S.No. 128/ 2 at Rajupeta, Tiruvuru, Krishna District of the petitioner, at the instance of the 4th respondent without registering any case against the petitioners herein is illegal, void and opposed to Articles 14, 19, 21 and 300-A of the Constitution of India and consequently to direct the respondent No. 2 to 3 be directed not to harass, interfere with the possession enjoyment of the petitioner's property...."

The Assistant Government Pleader (Home) places on record the written instructions, dated 14.11.2017 and the operative portion reads as follows :- " It is submitted that the contention of the petitioner that the 2nd respondent Station House Officer, Tiruvuru police station harassed and interfered with the civil dispute in RS.No.128/ 2, admeasuring Ac.0.16 cents, situated at Rajupeta, Tiruvuru, Krishna District at the instance of the 4th respondent Uppathala Naga Raju is not correct and baseless. It is submitted that the 2nd respondent has never called the petitioner to the Police Station and never harassed or interfered with the civil dispute between the petitioner and

the 4th respondent with regard to the above said property at any point of time.

The contention of the petitioner against the 2nd respondent Station House Officer, Tiruvuru police station are not correct, baseless, far from truth and has been created for the purpose of filing the present writ petition. The writ petition is devoid of merits and liable to be dismissed. By placing on record the statement of the Assistant Government Pleader, the writ petition is disposed of accordingly. No order as to costs.
