HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8789 of 2015 ORDER:

This criminal petition, under sections 437 & 439 of the Code of Criminal Procedure, is filed by the petitioner-Accused No.1 seeking to grant bail in CC No.109 of 2015 on the file of I-Additional Sessions Judge, Anantapuram, arising out of Crime No.104 of 2014 of Narpala Police Station, Anantapur District, registered for the offences punishable under Sections 120-B, 147, 148, 364-A, 368, 386, 324, 326 and 506 read with 149 IPC and Section 25(1-B)(a) of Arms Act. The allegation against the petitioner is that he along with other accused kidnapped the husband of the de facto complainant by beating him with hands and sticks and they demanded Rs.1.00 crore from the de facto complainant for release of her husband. Heard and perused the material available on record.

Learned Public Prosecutor submitted that the petitioner is a habitual offender and he was involved in several cases and on one occasion, he escaped from the police custody and thereafter, he committed the present crime. He further submitted that the schedule also fixed for examination of the witnesses in the sessions case. In view of the serious allegations against the petitioner and also taking into consideration the submissions made by the learned Public Prosecutor, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Petition is dismissed.
