HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION NO. 2826 OF 2015 O R D E R :
This writ petition is filed by the petitioner to declare the action of the respondents in interfering with the civil dispute of petitioner as arbitrary, unconstitutional and violation of Article 14 and 21 of the Constitution of India and consequently to direct the respondents not to interfere with the civil dispute between the petitioner and respondents 5 to 8 in respect of the land admeasuring Acs:10-00 bearing survey No. 341 of Uddemarry village under Shamirpet Mandal, Ranga Reddy district and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.
2. Heard the learned counsel for the petitioner and the learned Government Pleader for Home [TG] appearing for the official respondents 1 to 4.
3. Aggrieved by the action of the fourth respondent under the influence of the un-official respondents, there was an unlawful interference with the petitioner in the civil dispute pertaining to real estate.
4. Sri Ram Mohan, Assistant Government Pleader [TG], on written instructions dated 20-2-2015 submits that the Station House Officer, Shamirpet Police Station, registered a case in Cr.No. 30 of 2015 against the petitioner for the offences punishable under section 447, 427, 506 of IPC on 28-1-2015 and the same is under
investigation and the fourth respondent as a part of duty investigated into the matter and is not under the influence of the respondents 5 to 8. However, it is made clear that the official respondents are refrained from making abuse of their power.
5. With the above observation, the writ petition is dismissed. No costs.
6. As a sequel, miscellaneous petitions if any pending in this writ petition shall stand closed.
