B. Usha Rani, Wife Of B.P.Raju, v. The State Of Telangana,
HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.Nos.709 and 714 of 2015 COMMON ORDER:
Heard.
These two writ petitions are filed by the same petitioner alleging inaction on the part of the respondents in registering her complaint and considering her representation, dated 28-11-2014. The petitioner states that she along with her husband purchased a house bearing No.7-752/1 situated at Devendernagar, Gajularamaram, Quthbullapur Mandal, Ranga Reddy District, on 2805-2013. However, on the allegation of encroachment of Government land in Sy.No.329/1 of the same village, some complaints were made by third parties, which resulted in unsocial elements resorting to illegal trespass into the petitioners house and damaged few articles, stolen some money, documents and a Gas Cylinder. They also alleged to have beaten the petitioner and abused in the name of caste. Alleging inaction on the part of the respondents in registering her complaint and considering her representation, dated 28-11-2014, the petitioner filed the present writ petitions.
The instructions received by the learned Government Pleader however show that basing on the complaint of the petitioner, dated 2810-2014, a case in Cr.No.948 of 2014 was already registered on 3010-2014 against the persons, who are alleged to have beaten the petitioner and abused her in the name of caste and the Assistant Commissioner of Police, Balanagar Division, took up investigation in the case. It is also stated that earlier the Mandal Revenue Inspector, Qutubullapur Mandal, Ranga Reddy District, filed a complaint against the petitioner and others and based on which, a case in Cr.No.1102 of 2014 was registered for the offences punishable under Sections 4 and 6 of the A.P.Land Grabbing Act on 01-12-2014. The petitioner herein
is shown as A1 in the said FIR. So far as the petitioner's complaint dated 28-11-2014 is concerned, it is stated that the same is said to have been made to the Tahsildar, Qutubullapur Mandal and since the 4th respondent has not received any such complaint, no action could be taken thereon.
In view of the above, therefore, it is evident that two crimes are already under investigation and out of that, a case in Cr.No.948 is registered on the complaint of the petitioner. Hence, in my view, no further orders are necessary except directing the Investigating Officer concerned to complete the investigation and file appropriate report/charge-sheet before the jurisdictional Magistrate expeditiously.
Accordingly, the Writ Petitions are disposed of. No order as to costs.
The miscellaneous petitions, if any, pending in these writ petitions shall stand closed.
