HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 4332 of 2002 O R D E R:- This writ petition is filed seeking to issue a writ of certiorari calling for the records relating to the Award dated 27.07.2001 in I.D.No. 72 of 2000 passed by the Industrial Tribunal-cum-Labour Court, Godavarikhani and quash the same by holding it as arbitrary and illegal and sought a consequential direction to the 1st respondent - Corporation to reinstate the petitioner into service with continuity of service, full back-wages, attendant benefits and other service benefits.
Heard Sri A. Sanjeev Kumar, learned counsel for the petitioner and Sri A.Ravi Babu, learned Standing Counsel for A.P.S.R.T.C. appearing on behalf of the 1st respondent and perused the material placed on record.
The brief facts of the case are that the petitioner was appointed as Conductor in the year 1985. While so, on 13.03.1999, the 1st respondent issued a charge sheet for the alleged cash and ticket irregularities, and after conducting detailed enquiry, the petitioner was removed from service on 28.06.1999. Challenging the order of removal, the petitioner preferred industrial dispute in I.D.No. 72 of 2000, and the learned Tribunal, dismissed the same by confirming the order
AKS,J WP_4332_2002 of removal. Being aggrieved by the award of the Tribunal, the present writ petition is filed.
When the matter is taken up for hearing, the learned counsel for the petitioner submits that the petitioner has already retired from service after attaining the age of superannuation and the benefits to which the petitioner was entitled for having rendered more than 14 years of services, and his terminal benefits, be paid to him.
The learned Standing Counsel has fairly conceded that the petitioner is entitled to the benefits for the services rendered by him.
Considering the above submissions, the writ petition is disposed of directing the respondents to release pension benefits for the services rendered by the petitioner from the date of his appointment in the year 1985 to 28.06.1999 i.e. the date of his removal, within a period of four weeks from the date of receipt of a copy of this order, if not already paid. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
