HONOURABLE SRI JUSTICE A.V. SESHA SAI CIVIL REVISION PETITION No. 418 OF 2015 ORDER:

The plaintiff in O.S.No.103 of 2012 on the file of the Court of learned Senior Civil Judge, Jagtial, Karimangar District, is the petitioner in the present Civil Revision Petition, filed under Article 227 of the Constitution of India. The petitioner herein instituted O.S.No.103 of 2012 for declaration of title and other

reliefs. In the said suit, the petitioner herein filed I.A.No.361 of 2012 on 07.06.2012 under 39 Rules 1 and 2 of Code of Civil Procedure, seeking temporary injunction, to restrain defendants 1 and 2/respondents 1 and 2 herein, their men, servants and agents from alienating or transferring the suit schedule property to any third party. The grievance of the petitioner in the present revision petition is with regard to non-disposal of the said application by the Court below.

According to the information available before this Court, the petitioner herein filed I.A.No.361 of 2012 before the Court below, seeking temporary injunction as long back as on 7.6.2012 and the same is pending consideration before the Court below since then. Since the petitioner is seeking an innocuous order for disposal of the said interlocutory application, this Court deems it appropriate to grant the same.

For the aforesaid reason, the Court below is directed to dispose of I.A.No.361 of 2012 in O.S.No.103 of 2012 filed by the petitioner herein, on merits, as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order.

With the above direction, the Civil Revision Petition is disposed of. Miscellaneous petitions pending consideration if any in the Civil Revision Petition shall stand closed in the light of the aforesaid order. No order as to costs.
