HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.34437 of 2017 ORDER:

Heard Sri G.Vijaya Babu for petitioner and the Assistant Government Pleader for Home.

The petitioner prays for the following relief :- " ..... to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 1 to 3 in closing the petitioners Cafe D Bristo Coffee Shop illegally on 19.09.2017, run by the petitioner after obtaining all the Statutory permissions without issuing any Notice and giving opportunity of hearing as illegal, arbitrary and contrary to Article 14 of the Constitution of India apart from violation of Principles of Natural Justice and consequently direct the respondents 1 to 3 to allow the petitioner to run his Cafe D Bristo Coffee Shop....." . Sri G.Vijaya Babu limits his submission that though a representation was made to 1st respondent on 23.09.2017 against illegal seizure or closure of Coffee Shop on 19.09.2017, the representation is not disposed of. He submits that the petitioner is content, if the representation is examined and a reply is given by respondents 1 and 2.

The Assistant Government Pleader submits that the seizure of Coffee Shop is pursuant to the report forwarded by 2nd respondent to 3rd respondent and the representation of the petitioner will be examined and disposed of within four weeks from the date of receipt of a copy of this order.

The statement is placed on record.

The writ petition is disposed of by this order. (a) The petitioner is given liberty to re-submit representation, dated 23.09.2017 to respondents 1 and 2 by enclosing a copy of this order within four weeks from today.

(b) Respondents 1 and 2 are directed to dispose of representation, dated 23.09.2017 in accordance with law, after affording opportunity to the petitioner as well, within four weeks thereafter.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
