HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 38834 of 2018 ORDER:

1) Heard.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondents in seizing the lorry bearing No.TS 23T 2116, without following any procedure under statutes contemplated under Section 9Q Sub-Section 7 of Minor Mineral Concession Rules, belonging to the petitioner, as illegal and arbitrary.

3) The grievance of the petitioner is that though he made a representation on 24.10.2018 to respondent No.2 seeking release of his vehicle by following Government norms as envisaged under the GO Ms.No.3, dated 08.01.2015 and G.O.Ms.No.15, dated 19.02.2015, the same is refused by respondent No.2. 4) At the time when the matter is taken up for hearing, learned Standing Counsel would submit that if the petitioner makes a fresh application before the concerned, in accordance with law, the same shall be disposed of at the earliest.

5) Having regard to the above, the writ petition is disposed of directing the petitioner to make a fresh application seeking release of the vehicle in terms of law, before the concerned authority, in which event, the authorities shall dispose of the said application on the

same day, at the earliest, in accordance with law and as per the terms and conditions as the authority deems fit and appropriate to release the vehicle.
