Heard.
The grievance of the petitioners is that a case in Cr.No.375 of pending before Bowenpally Police Station is not being investigated.
Learned Government Pleader has received instructions from the 4th respondent, which state that in view of the interim order granted in Crl.P.No.16460 of 2014 with regard to stay of all further proceedings in Cr.No.375 of 2014, the 4th respondent has stopped investigation in the said Crime. It is also stated across the Bar that the petitioners have already filed vacate stay application in the said Criminal Petition by specifically stating that the conditional order of stay granted by this Court in the said Criminal Petition is not complied with. Even, in this writ petition, learned counsel for the petitioners has obtained a copy of website relating to the case status of the aforesaid Criminal Petition. But, it is not clear as to whether the conditional order in the said Criminal Petition is complied with by the petitioners therein.
Since the petitioners have already filed vacate stay application in the said Criminal Petition, it is appropriate for the petitioners to prosecute the said vacation stay petition. In the circumstances, therefore, no direction can be given to the respondent Police to complete investigation in Cr.No.375 of 2014.
Hence, the writ petition is disposed of giving liberty to the petitioners to prosecute the vacate stay petition, referred to above. No order as to costs.
The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
