THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.3848 OF 2015 ORDER:

The prayer sought for in the present writ petition is as under:

"to issue a WRIT OR ORDER OR DIRECTION more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the 1st respondent in not passing orders on the appeal dt. 06-02-2014 preferred by the petitioner against the orders dt. 15-12-2013 vide Rc. No. C5(M)/1533/2013 passed by the 3rd respondent as being illegal, arbitrary, untenable, contrary to the orders dt. 2102-2014 passed by this Hon'ble Court in W.P.No. 5015/2014 violative of Art. 14, 16 and 21 of the Constitution of India and consequently direct the 1st respondent to pass orders on the appeal dt. 06-02-2014 preferred by the petitioner as per law against the orders dt. 15-12-2013 vide Rc.No. C5(M)/1533/2013 passed by the 3rd respondent." The petitioner is working as Secondary Grade Teacher, MPUP School, Neelaballi , S.P.S.R. Nellore District.

She belongs to "Yerukala" community, which is classified as Scheduled Tribe and the competent authority has also issued the Caste Certificate in the year 1999. However, upon the recommendations of the District Level Committee, without there being any enquiry, the District Collector-3rd respondent herein through impugned proceedings dated 15.12.2013 cancelled the caste certificate issued in favour of the petitioner. Aggrieved thereby, the petitioner preferred statutory appeal on 06.02.2014 before the 1st respondent herein, but however, so far, no orders have been passed.

The entire exercise shall be completed within a period of two months from the date of receipt of a copy of this order. With the above observations, the writ petition is disposed of. No costs.
