Mohammed Qadeer, S/O. Late M. A. Rahman, v. The Principal Secretary (Home),
HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.12084 of 2015 ORDER:
Heard.
The petitioners complain that the 3rd respondent, at the instance of the 4th respondent, is interfering with the civil dispute, which is the subject matter of E.P.No.8 of 2013 pending before the IX Junior Civil Judge, City Civil Court, Hyderabad, and allege that there is an attempt by the 3rd respondent to dispossess them from the property in question.
Learned Government Pleader has received instructions, which state that as on 30-04-2015 no complaint or case is registered against the petitioners at Madannapet Police Station and the dispute between the petitioners and the 4th respondent appears to be a civil dispute and the respondent police is not concerned with the same. The allegation of the petitioners that the respondent police interfered or pressurized them etc., is denied and the writ petition is filed merely on apprehension for a preventive relief against the respondents. As is evident from the instructions above that the writ petition is filed merely on apprehension and to seek anticipatory relief. Hence, no further orders are necessary.
Accordingly, the Writ Petition is dismissed. No order as to costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 01-05-2015 Prv
