Petitioners pray for the following relief:
"For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent Nos. 2 to 5 in dispossessing the petitioners from the lands in Sy. No. 281/6, 280/1, 281/2, 281/1, 280/3, 282/8, 281/3, 282/5 and 280/4 with an extent of 2-58, 1-18, 3-04, 3-00, 1-48, 0-64, 2-59, 1-35 and 1-48 cents respectively of Velcheru Village, Rambilli Mandal, Visakhapatnam District without any notice, without following the procedure and without payment of compensation is highly illegal, arbitrary and in violation of Articles 14 and 300-A of the Constitution of India and consequently direct respondent Nos. 2 to 5 not to dispossess the petitioners from the lands in Sy. No.
281/6, 280/1, 281/2, 281/1, 280/3, 282/8, 281/3, 282/5 and 280/4 with an extent of 2-58, 1-18, 3-04, 3-00, 1-48, 0-64, 2-59, 1-35 and 1-48 cents respectively of Velcheru Village, Rambilli Mandal, Visakhapatnam District without following the procedure as contemplated under law and without payment of compensation and pass such other order or orders as this Hon'ble Court deemed fit and proper in the circumstances of the case." Learned Government Pleader, on instructions, submits that the respondents in fact are trying to handle or remove the gravel available in Survey Nos. 257 and 130 covering an extent of 37.65 cents and Acs. 116.85 cents respectively, of Velcheru Village, Rambilli Mandal, Visakhapatnam District.
From the written instructions received by the learned Government Pleader, it is clear that the activities now undertaken by the respondents are not concerning the subject matter of the writ petition. The said statement is placed on record and the writ petition is disposed of.
It is needless to observe that if at all respondents intend to interfere with or deal with the petitioners' lands in any manner, the same shall be in accordance with law. Consequently, pending miscellaneous applications shall also stand closed. No costs.
