Heard learned counsel for the petitioner.
The petitioner was imposed major punishment of dismissal from service vide proceedings dated 11-05-2016 and modified the said punishment into compulsory retirement vide proceedings dated 21-02-2017 on the revision petition filed by him to the 3rd respondent. Having agreed for punishment to be modified from dismissal to compulsory retirement, now the petitioner is estopped from contending that the impugned orders are arbitrary and liable to be set aside. Though learned counsel for the petitioner argued at length on merits, but revision petition filed by the petitioner was disposed of converting dismissal to that of compulsory retirement and the said aspect is not disputed by learned counsel for the petitioner.
In view of the same, I do not see any reason to entertain the writ petition by exercising power of judicial review under Article 226 of Constitution of India.
Accordingly, the writ petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
