The petitioners claim to have succeeded an extent of Ac.6.06 gts., in Sy.No.297/AA/4 situated at Buradaraghavapuram village, Enkuru Mandal of Khammam District, from their grand father late Uggam Ramulu, who in turn acquired the same by way of purchase under simple sale deed dated 11.04.1957 from the 5th respondent herein, and since then they have been in possession and enjoyment of the same. While so, the 3rd respondent, by showing the 5th respondent as petitioner, initiated enquiry with respect to the above land under Andhra Pradesh Scheduled

Areas Land Transfer Regulations Act, 1969, and vide proceedings in LTR Case No.304/2001/ENK dated 18.06.2005 passed eviction orders directing the 4th respondent to take possession under a cover of panchanama. Against the said order, the petitioners filed a statutory appeal before the 2nd respondent in C.M.A.No.58 of 2007. The grievance of the petitioners is that though written arguments were submitted on 15.10.2007, the 2nd respondent did not pass any orders in the said appeal. Hence the petitioners approached this Court by way of this writ petition.

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Social Welfare for respondents.

Considering the short relief sought for in the writ petition, without expressing any opinion on merits, I deem it appropriate to dispose of the writ petition directing the 2nd respondent to dispose of the appeal filed by the petitioners within a period of one month from today. Pending disposal of the appeal, status quo obtaining as on today shall be maintained by both the parties. With the above directions, the writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any, shall stand closed. _____________________ CHALLA KODANDA RAM, J.
