HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 23130 of 2016 ORDER:

Heard learned counsel for the petitioner and Sri N.Ashok Kumar, learned Standing Counsel for the respondents. There is no necessity to put the unofficial respondent on notice as this Court is not venturing to adjudicate the issue on merits.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondent Nos. 1 to 3 in not removing the encroachments made by respondent No.4 in front of H.No.10-1-810, A.C.Guards, Hyderabad, by considering the representation dated 18.06.2016, as arbitrary, illegal and contrary to the provisions of the Greater Hyderabad Municipal Corporation Act, 1955.

Though various grounds are raised in the writ petition, learned counsel for the petitioner submits that though the petitioner made a representation on 18.06.2016 till date no orders are passed and hence seeks a direction to the second respondent to consider his representation dated 18.06.2016 at the earliest. Learned Standing Counsel for the official respondents submits that if the said representation is still pending the same shall be considered in accordance with law.

Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing the second respondent to pass

orders on the representation dated 18.06.2016 made by the petitioner, in accordance with law, as expeditiously as possible, preferably within a period of one week from the date of receipt of a copy of the order, after hearing the petitioner and the un-official respondent. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
