HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.39324 of 2017 ORDER:

The short and long of petitioner's prayer is that the complaint alleged to have been filed by fifth respondent is to be taken up on record and proceeded with investigation in accordance with law.

The learned Assistant Government Pleader (Home) on instructions submits that to make preliminary enquiry, twice the petitioner was called to Police Station to find out the veracity in the complaint even before making a General Diary entry. As the petitioner is insisting upon strictly following the procedure in accordance with law, this Court considers it appropriate to direct the fourth respondent to take on file the complaint said to have been given by fifth respondent, make an entry in General Diary and the fourth respondent is under obligation to proceed strictly in accordance with law. The Writ Petition is disposed of accordingly. As a sequel, Miscellaneous Petitions, if any, pending, shall stand closed.
