THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3702 OF 2016 ORDER:

This Criminal Petition is filed by the accused No.1 to 8 under Section 482 of Cr.P.C. seeking to quash the proceedings in Crime No.277 of 2015 on the file of Kurnool II-Town Polcie Station for the offences under Sections 498-A, 420, 506 r/w 34 IPC and Sections 3 and 4 of Dowry Prohibition Act. On perusal of the entire material available on record, prima facie there are some allegations as against the petitioners and truth or otherwise of the said allegations can be ascertained by the investigating agency during the course of investigation and this Court is not inclined to quash the proceedings in the said crime at this stage.

At this stage, learned counsel for the petitioners submitted that in view of the pendency of the above crime, the petitioners apprehend arrest and also harassment in the hands of the police.

In view of the above, the police concerned are directed to complete the investigation into the crime without arresting the petitioners herein and file a final report, if any, in accordance with law.

The petitioners are directed to appear before the investigating agency as and when required and cooperate with the investigating agency.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
