HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.37192 OF 2017 ORDER:

This writ petition is filed challenging the proceedings in Rc.No.1219 of 2017-C dated 31-10-2017, wherein the 2nd respondent issued notice of 'No Confidence Motion' against the petitioner.

Learned counsel for the petitioner submits that the petitioner made representation on 18-10-2017 about illegal demands of the unofficial respondents before making representation by unofficial respondents on 20-10-2017 to the 2nd respondent to convene a meeting for 'No Confidence Motion'. Without disposing said representation, impugned notice is issued.

On the other hand, learned Assistant Government Pleader for Cooperation submits that when whole committee was against the petitioner and agreed for No-Confidence Motion and there is no other way except to issue notice under Section 34-A(2) of the Telangana Co-operative Societies Act( for short "the Act") It is to be seen that Section 34-A of the Act is not circumscribed by any condition and reading of Section 61 of the Act also goes to show that 'No Confidence Motion' is different and independent action under Section 34-A of the Act and scope of Section 61 of the Act is altogether is different. In view of the same, I am unable to accept the contention of the petitioner. Having regard to the above, I do not see any merit in the writ petition and accordingly the same is dismissed. However, the 2nd respondent shall take necessary action on the representation of the petitioner dated 18-10-2017 in accordance with law. As a sequel

to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
