The petitioner complains against 5th respondent on the alleged harassment, basing on the complaint given by the 6th respondent, in the present writ petition. The prayer reads as follows:

"...........Writ of Mandamus declaring the action of the Respondents and Respondent No.5 in particular in harassing the petitioner on the basis of the complaint lodged by the Respondent No.6 without following the procedure laid down by the Hon'ble Supreme Court of India, in Rajesh Sharma Vs. the State of Uttar Pradesh as illegal, arbitrary and violation of articles of 14, 15, 16 and 21 of the Constitution of India........."

The Assistant Government Pleader, on instructions, submits that Crime No.797 of 2017 under Section 498-A IPC r/w Sections 3 and 4 of DP Act are registered and investigation is in progress. It is further submitted that as allegations require investigation, the petitioner to avoid harassment by 5th respondent has filed the instant writ petition.

After perusing the affidavit and also Crime No.797 of 2017, this Court is of the view that the writ prayer is

premature. Hence, the writ petition is dismissed. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
